Lawsuit in Pitt County to Stop Illegal Democrats

GREENVILLE, N.C.—The Pitt County Republican Party and an aggrieved voter have filed a lawsuit today in Pitt County Superior Court against the Democratic Legislative Campaign Committee ( a Washington, D.C. based “527” ) and the DLCC North Carolina PAC (a North Carolina “Campaign Committee.”) The lawsuit accuses the 527 D.C. based organization and the NC PAC of engaging in illegal campaign activities.

Specifically, the lawsuit alleges that the NC PAC is really the alter ego of the 527 D.C. organization. The 527 D.C. organization accepts and spends corporate contributions, which are unlawful for North Carolina political committees. The lawsuit also alleges improper reporting and failure to report by the organizations.

The lawsuit also alleges the unlawful activity of “giving in the name of another,” a crime which ultimately led to the incarceration of former Speaker Jim Black. It is noteworthy that Jim Black was at one time the Finance Chairman of the 527. The lawsuit is asking a Pitt County Superior Court Judge to enter an injunction prohibiting the 527 and its alter ego from making expenditures in this year’s election.

Kieran J. Shanahan, Principal of the Shanahan Law Group, who is serving as legal counsel to the Plaintiffs said: “The injunction sought in this lawsuit is essential to the voters in North Carolina if we are to have a fair and honest election conducted on a level playing field.” Shanahan further stated: “It is regrettable that the Board of Elections has ignored its own staff’s warnings about this situation and that it has failed to act to protect the integrity of the voting process in North Carolina.”

Some of the charges in the lawsuit include:

* That the Democratic Legislative Campaign Committee, which is based in Washington, D.C., accepted corporate contributions and illegally transferred them to the DLCC North Carolina PAC in an effort to influence legislative elections in North Carolina.
* That the Washington D.C. based Democratic Legislative Campaign Committee failed to properly file any disclosures with the N.C. State Board of Elections.
* That the Washington D.C. based Democratic Legislative Campaign Committee raised and accepted money in its name, then transferred the money to the DLCC North Carolina PAC as contributions purportedly under the original contributor’s name.

Kimberley Hendrix, the Plaintiff suing as an aggrieved voter, said: “The people of North Carolina are tired of folks from outside of North Carolina trying to influence our elections. And, if you are going to get involved, you need to play by the rules.”

THE COURT HAS SCHEDULED A HEARING ON PLAINTIFF’S MOTION FOR PRELIMINARY INJUNCTION ON OCTOBER 10 IN THE PITT COUNTY COURTHOUSE, GREENVILLE, NORTH CAROLINA.

Mooresville Recycling

How about I show you how government specifically is interested in control and power instead of freedom and people? Here it is, on a tiny town level. Mooresville, NC has around 10,700 households. It’s not a big place. Their government is considering forcing people adding recycling. Yes, I’m well aware this is how you force people to recycle because you make it voluntary at first, then mandatory later on to “save costs.” It’s crappy, horrible, controlling, anti-freedom government at it’s worst.

But the government put together a presentation that shows they honestly do not care one bit about how much money they spend. Sure, if you take the presentation at face value, it looks like this effort would actually bring income to the city. But if you look a little closer, you see that’s not actually the case.

In one place, the presentation bases all its numbers, including those that show a “profit,” on a 70% household participation. However, on the previous page, they show the nationwide average figures of participation is 40-80%, and their own goal is only 50%! So the city is going to try and get 50% participation, but bases ALL the calculations and figures on 70%! I don’t know if you can call that outright lying, but it sure is dishonest in every sense of the word. They also don’t mention in the presentation the line that helps them “earn” money listed as “tax income.”

Worse, they go on to claim that it would cost more if they let a private company do the collections for them — and then provide the data to show that’s completely untrue! The presentation claims that a private company will pick up recycling for just $3.75 per house per month. That’s all. So what would happen in a freedom-based country? The claimed 72% of town residents that want recycling could just pay $3.75 a month and get it. That’s it. There would be no government employees to pay. There would be no administrators to pay. There would be no mismanagement by the government. And best of all — the 28% of residents who do not want to be forced to pay to make other people feel good WOULDN’T HAVE TO PAY!

In other words, the options are clear. Government can use force to require people to pay them, and government will spend nearly $70 a year per household; or people could be free to contract with other free people to get curbside recycling for less than $4 a month (around $48 a year). I bet you can guess what the board “suggested” that the town do, can’t you? Government today, even in small towns, is about using force to control people and nothing more.

The Foreclosure “Crisis”

I have been trying to explain why the US government is completely and totally wrong and well-beyond it’s Constitutional boundaries regarding the recent economic news. I have been trying to explain that most of the current problems are because of government interference in freedom. I just read a news release from Chris Cole, running for the US Senate on the Libertarian Party ticket in North Carolina (against Liddy Dole (RINO)):

From Christopher Cole, Libertarian for US Senate

I am a collector of antique American currency. Included in my collection - and my personal favorites- are several gold certificates. Most Americans aren’t even aware that we once had bills that bore legends like “20 Dollars in Gold Coin Payable to the Bearer on Demand”. They are especially surprised by their orange back, intended to emphasize their value in gold. (The twenty bears the image of George Washington familiar from our modern one-dollar Federal Reserve Note.)

Why do I mention my collection? Because that twenty-dollar gold certificate was pegged at an exchange value of one ounce of gold. It was worth that ounce the first year, the second year, even ten years after it was printed. What is the price of an ounce of gold now? Over $800. In other words, the value of our currency has fallen more than fortyfold! No wonder the government no longer issues gold certificates, and no wonder our savings rate has fallen to about one-half of one percent. It is against self-interest to hold money that is worth less, the longer you hold on to it.

Thus, we have the setup for our current credit and foreclosure crisis.

When money is saved, its owner intends its use in the future, and the bank uses it to make loans, such as for the creation of new businesses. More savings mean lower interest rates, which in turn send a market signal for businesses and individuals to invest for future demand. The real interest rates based on savings have been replaced by artificial signals from Federal Reserve-set interest rates, along with home- and land-ownership incentives by government. The result has been a market expectation of future increases in demand for homes and land, and thus, a real-estate price bubble. All of which was fine, as long as there was an ACTUAL demand in the future. What has happened is that demand no longer matches the fake interest signal, and the housing bubble has burst.

The solution offered by politicians, such as Republican Senator Elizabeth Dole, is to pump Federal Reserve loans into Fannie Mae and Freddie Mac, to finance MORE loans for folks who couldn’t otherwise
qualify for them, setting up ANOTHER housing bubble and MORE foreclosures, not fewer. Quick fixes can always be expected to result in longterm problems.

The longterm solutions are harder. Here are the ones I would institute as Senator:

First, restore the gold standard, so Americans can know that they will not lose their savings to inflation.

Second, phase out government programs that subsidize home ownership. This must include setting a date for the revocation of the charters of Fannie Mae and Freddie Mac (I suggest four years), so that they will cease sending false market signals, without stranding current buyers and sellers.

And third, abolish the Federal Reserve System, enabling interest rates to float in response to real savings, rather than to government social engineering.

For additional information, I recommend this article from the Ludwig von Mises Institute, an economic think tank based at Auburn University.

Vote Libertarian in North Carolina in 2008

Why? Remember that 9% approval rating? It’s not throwing away your vote, especially in North Carolina. If 90% of the people don’t like the current government and just half of them vote Libertarian, freedom will have a chance. Want to know why? Just watch this video:

NC Senate Creates Criminals

So I bet you didn’t read the big news in the North Carolina media this weekend. But I guess that’s because the media is more interesting is getting you angry at Republicans so the media can win the elections and keep advancing socialism. Meanwhile, the North Carolina Senate passed a law that creates tens of thousands of new criminals. In addition, it makes tens of thousands of people who are absolutely no danger to anyone unable to purchase firearms. Why? Because government simply does not like people to be armed and will not put up with the damn citizens having guns. No, really, that’s why.

The new law makes it illegal for anyone who has ever been referred by a judge to a psychologist ineligible to own a gun. You can be sure that government employees (policemen) will be exempt from this (and lots of other) law. And to get the law passed, they did add a section that claims that if you are barred from buying a gun, you can beg and plead government for permission once again. And of course, it will be up to the black-robed ones to give you permission.

So now, in North Carolina, if you go to a judge because you got a speeding ticket and the judge decides you need “anger counseling,” you’re barred for life from buying a gun in the United States. Seriously, that’s what the law says. I guess the black market in guns will just have to continue to expand.

Manning Rules Bribery Legal

Judge Howard Manning (self-appointed literal King of North Carolina Education) has ruled that it is legal to take money by force from some people and use that money to give to other people in return for services. And yes, I’m well aware that most people, upon reading that, would claim that it’s bribery and theft. But this judge, ruling for the Durham County Superior Court, has said it’s not.

Now wait — before you head out and start taking money from people — that’s illegal for you. And wait before you start using other people’s money to bribe companies — that’s illegal for you, too. But it’s not illegal when government does it — which is what King Manning has proclaimed (and you had better not question the king).

King Manning has ruled that government can take taxpayer money and use it to bribe different businesses to locate to their community — favoring whatever business that gives them the most cash. Gee, what’s next, government taking private land to give to businesses that give them cash? Oh right, that’s already happening. Oh, how I yearn for freedom.

CMS: Politics over Education

If you have any doubt about the priorities of the government education system, just watch the Charlotte-Mecklenburg Schools (CMS) in action. They, and I’m sure most government schools around the county, have one priority: cash.

Yesterday the superintendent (who earns nearly half a million dollars a year in salary and other compensation) announced job cuts. And of course, he blamed it on not having enough money. Why? Because it’s a political move, plain and simple, designed to get voters to support giving even MORE cash to the schools. The facts are clear (even if you won’t get them from his allies in the media): the school district has MORE money than last year to spend. They have enough to give every employee a raise of at least three percent. But that’s not how much Peter Gorman (the $500,000+ superintendent) personally wanted, so he’s going to fire people until the government gives him, personally, more cash.

Extort: To obtain from another by coercion or intimidation.

This is the function and purpose of the government school system. They seriously and honestly do not care one bit about the children or education in any way, shape, or form. I wish there were some way to make people understand that. I guess most people don’t want to hear that because their kids are in the government prison school system, so they don’t want to admit that the school stinks as bad as it does.

Congressional Approvals

I’m sure many of you fine readers have heard about the record low Congressional approval numbers. I mean, nine percent? Over 90% of people think you’re a failure at your job? Knowing that in large groups, you will always have “that 10%,” this is almost a complete and total rejection of the entire US Congress. That really is news. I wonder how those people can do their jobs, knowing that almost no one thinks they’re doing it right. Oh wait, I remember — because they honestly don’t care (most of them). They’re the elite and they know better than you what’s good for you. If you don’t think they’re doing their job right, it’s not because they’re not, it’s because you don’t understand their job.

What a load.

What’s even more interesting is the fact that of the same 90% who think that Congress is completely worthless at the moment, the majority of people say they’ll vote to re-elect their Congressman. I guess if Congress is truly dysfunctional (and it is), does this mean that the people they’re electing are even MORE dysfunctional? It sure does give a new meaning to “throwing away your vote.” This poll, if even slightly accurate, says that the VAST majority of Americans are going to vote to re-elect someone they think is completely and utterly incompetent. How can that be?

I suggest it’s because so few people have a choice. I know in North Carolina, and I’m sure many other places, there’s simply no competition. In the two-party system, you pick one of the following one candidates. Either that or your district is drawn to include 70% one party, so the other party candidate doesn’t have a chance, anyway.

I’d like to suggest that there’s other options. In North Carolina, for the first time in years, you actually have a choice. The North Carolina Libertarian Party has actually been permitted to be on the ballot. No, the Democrats and Republicans don’t like it, but they were forced to allow it. If you’re in North Carolina, go take a look — the Libertarian Party has almost 40 candidate running for various offices statewide. I’m not asking you to agree with the entire party platform — do you agree with ANY party platform 100%? I just think votes for Libertarians really can send a message to the Congress that we really, really don’t like what they’re doing.

NC Budget

So, the Democrats in North Carolina just passed a new budget. Twenty-one BILLION dollars worth of a budget. Yes, that’s $21,355,967,434.00. For just one state. And I, for one, think that’s an awful lot of money, even if the Democrat Legislators don’t care — because after all, it’s not their money, they don’t really care how much they spend, do they?

$2.6 billion goes to The University of North Carolina. What? You actually thought that tuition paid for schools? Obviously not. Wouldn’t that be neat, though? To have optional institutions actually take in money to pay for their own operations? Instead, you, the taxpayer, whether you’re using the schools or not, will pay for other people to get an education. And that’s on top of the just under $1 billion given to the Community College system that the Democrats want to educate illegal immigrants (while claiming taxpayer money isn’t used to educate illegals).

But hey, how can we possible live without giving $78 million to the “Rural Economic Development Center?” I guess without that expenditure, no one would ever build anything in any rural areas. Whew, glad government could save that one for me.

And remember all those “free” bonds that have passed over the years? Yes, just like the one that’s one the ballot this fall for “roads?” This year North Carolina had to pay $678 MILLION in debt service. Any of you good readers have a credit card where you carry a balance? You see that little “finance charge” section? Right, that’s money you’re giving away — and North Carolina just spend $678 million on their finance charges — for just this year. There’s a reason that you’re not supposed to borrow from Peter to pay Paul.

But back to roads for a moment. Now remember, in North Carolina, the roads are crappy. They are under construction often — but usually long after they should have been repaired. They are not expanded until many years too late. Many roads are absolutely filled with potholes. The Democrats are trying to build toll roads because they claim they don’t have enough money to build roads. And this fall, Democrats are pushing to borrow huge sums of money because they claim they don’t have enough cash for roads. Now, shall we examine the Democrat budget for 2008-2009?

Under “income to the state,” we find $172 million transfer from the Highway Trust Fund. The next line has $17 million from the Highway Fund. To be clear, this is money that was already collected for the sole purpose of building roads — and the Democrats have taken it FROM the road funds and placed it in the general fund. The Democrats have been doing this for over a decade. And this year they actually stole LESS from the highway funds than in the past!

Know what else the Democrats have voted to do with money that was collected to build and repair roads? $32 million for ferry operations. Which would you rather have — cheap ferry service or good roads? Which helps more people? $21 million to railroads. Once again, which carries more people and goods to places they need to be — highways or railroads? But wait, there’s more!

There’s one line in the budget that just really lets you know where the priorities of the Democrats in North Carolina lie. The Democrats voted to take over $250 million that was collected to build and repair roads and “transfer [it to] other state agencies.” In other words, Democrats had $250 million to build roads and they chose to give it to their pals in state government including things like “Teachers’ and State Employees’ Retirement Compensation.”

When you hear legislators complaining that they “need” more money, realize what they’re really saying. They’re saying they “need” more money so they can spend it on things they like — not because the state needs a dime to actually do the things they should be doing. And while we do need roads, we do NOT need to borrow money to build them — instead we need to use the money we already have — we just need fiscally responsible people to account for it.

R.I.P. Jesse Helms

For those who did not know, US Senator Jesse Helms passed away a few days ago. His funeral is today. He was an absolutely amazing man.

To those who were outside of North Carolina, don’t believe all you heard or read about him. The media always portrayed him as an evil, heartless man. Nothing could be further from the truth. He was a truly kind and compassionate man — who always stood by his clear conservative principles. He has already been sorely missed from the US Senate. But I know they’re rejoicing in heaven today.

I wish there could be more men in politics like Mr. Helms. In today’s climate, I’m sure he would be even more vilified. Why? I believe it’s primarily because Senator Helms actually believed in right and wrong. That’s a concept that seems to be utterly and completely missing from the media today. Yes, there is right and wrong — and Senator Helms knew that. Rest in peace, good Senator. You did well.

Jobless Activists

One of the biggest problems with a government that pays people who don’t work is that you get people who have no purpose in life — who then decide they need to lobby the government for, well, whatever lunatic idea they can come up with (besides anything that gives them cash, of course).

This past week at the NC General Assembly, there were actually groups of people pressuring Democrats to pass a law making torture illegal. Apparently in the minds of these wackos, there’s a big problem with torture in North Carolina. No, no problems with billions of dollars in taxpayer money being used for illegal alien invaders. Nope, no problems with crimes and murders. Instead, we’ve got to pass MORE laws according to these wackos.

Feel free to read the linked story, but be prepared to be dumber for reading it. The article babbles on about how this state law will somehow stop the CIA from torturing terrorists in foreign countries. Don’t say I didn’t warn you.

An added side effect of giving me back my freedoms is that people like this who have nothing to do all day except collect their government checks will be required to work for a living and leave me alone. Wouldn’t that be nice?

Libertarians in North Carolina

Hey, did you know that Libertarians are allowed to run for election in North Carolina again? Yes, despite some of the most difficult ballot access laws in the country, they’re permitted again to run. And that’s despite a superior court judge who actually said, “there is no fundamental right for a voter to vote for the party of their choice.”

And yes, of course, libertarians candidates will be excluded from the election process as much as possible by the media, the Democrats, and the Republicans. But it sure is refreshing to see that in some elections people will actually have a choice. Keep in mind, this is the same North Carolina where as many as 80% or more of the state legislature only changes hands when those in power want them to (there’s zero competition).

So this year, why not join ‘em? If you live in an uncontested district, get your name on the ballot. It’s not too expensive and people will actually have a choice. You know, I think I’ll see if they want me on the ballot — I know in my districts, there’s zero opposition for either the state house or the state senate…

Winston-Salem Journal: Gimmie, Gimmie, Gimmie!

The editorial staff at the Winston Salem Journal have published their opinion on the current economy: you should give government more. Yeah, that’s about it. Oh, they’ll print lies, but that doesn’t matter. Oh, they’ll play on your feelings and make you feel bad while they’re lying, but they don’t care — they just want more and more and biggest government at any cost.

They claim that it’s bad that gas taxes are capped in North Carolina. They applaud the system that used to be in place in North Carolina that increased the rate of taxes on gasoline when the price went up. They are very upset that government might get a few dollars less to spend. Then they really start in with the lies. Here’s the biggest whopper of them all:

We pay gas taxes so we can have good roads.

Worse, some people who read that actually believe that. That’s a complete and total lie. Each year the Democrats in the General Assembly take the majority of the money collected in the form of gas taxes and throw it in the general fund. Then there is no money for roads. And funny, that’s what they campaign on each year. Over time, they have taken literally billions of dollars collected in gas taxes and spent them on their personal salaries, perks, and other things they just happen to want. It’s a total lie that gas taxes are used for road.

And yes, I understand that the North Carolina Constitution requires that gas taxes be used for roads. But when Democrats rule the state for over 100 years, they just ignore what the Constitution requires of them. They ensure massive gerrymandering so they can continue to easily retain control of the state so no one can stop them. And now when they have the editors of the Winston-Salem Journal spreading blatant lies supporting them, how can they be stopped?

No, this is not about not having enough money. It’s what it has always been — a statement on priorities. The ONLY reason North Carolina has crappy roads and not enough roads is because the Democrats who run North Carolina think it’s more important to give themselves raises and spend cash on their own projects. But don’t worry, this year the Democrats will put a $1 or $2 billion bond on the ballot this year — borrowing from Peter to pay Paul — and to put the burden of paying back for their mistakes on someone else. Welcome to today’s Democrat Party — forcing your children to pay for their parties.

NC Senate Demands Higher Taxes

Despite the open and vehement opposition of the voters of North Carolina. The Democrats in the NC Senate recently passed a tax increase — but they passed it so that they could claim at election time that they didn’t raise taxes. Instead of openly raising taxes (because that might cost them votes), Democrats in the Legislature voted to permit counties to increase the tax on moving (aka “land transfer tax”) massively — but only with the permission of the voters. EVERY single county that’s tried that has failed — miserably. The average loss for increasing the moving tax is 70-30!

But Democrats in the North Carolina Legislature don’t get it. They don’t care. It appears they will absolutely refuse to remove that taxing option — they believe that if the counties keep trying, they will be able to slip the tax increase through on an off-voting day, a special election day, or a second primary day when people won’t be looking.

The message is very clear from the Democrats who rule the North Carolina Legislature: We don’t give a DAMN what people want, we’re going to do whatever WE want to do, in spite of you morons who don’t want to give us your money.

Fund Toll Roads With Taxes, Not Tolls?

Yes, once again, witness the open lies and deception of the Democrats in North Carolina government!

All along, while the Democrats in the North Carolina legislature tried to convince the people of North Carolina to support toll roads, two issues were promised again and again. First, the people were told that all toll roads would be optional, alternative routes — in other words, no toll road would replace any main road so that if you didn’t want to pay for the toll road, you could still move about freely. Second, the people were told over and over that the toll roads would pay for themselves and that they wouldn’t cost people anything.

And of course, they lied.

The Senate has passed a bill that spends over $20 million a year to build toll roads. Worse, they’re proposing an increase of almost 30% for your car registration to pay for it.

It’s not a joke — when the NC Democrat politician’s lips are moving, they’re lying.

Repeal Freedom in NC!

So, the News-Observer says that there’s just too much freedom going on in North Carolina, and we need to stop some of it. They strongly support repealing the law that makes it illegal for public employees to join labor unions.

Now keep in mind, labor unions are beyond their use. They have little or no value today. They have few purposes. They primarily exist to enrich union leaders. As a secondary purpose, they exist to ensure less competition in the workplace. They use freedom crushing tactics to take money from members who disagree with them. They make it more difficult for people to work in their industry. They exist to protect higher wages and higher costs for whatever industry in which they reside.

Government employment is optional. NO ONE is forced into government employment. If you don’t like your job, just quit (unless you’re a union employee, in which case you might not be allowed to). There is no logical reason to support teachers and policemen joining unions. If they think they’re not being treated fairly, go find another job. I know that’s what I do. But of course, those who support this act will support it with outrageous lies without any basis in truth (like the idea that if it weren’t for unions, no one would ever get a weekend day off work — no really, they’re actually claiming that).
